Terms of Service

These terms are the agreement between you and MyStoryStays, operating as MyStoryStays in Ontario, Canada ("we", "us"). By placing an order or using the site you agree to them, along with our Refund & Shipping Policy and our Privacy Policy. We've tried to write them plainly. If anything is unclear, ask us.
1. What we offer
- Memorial pages: a page for someone who has died, with their story, photos and a guest book, opened from a QR code.
- The Page: a memorial page with a printable QR card, without a marker.
- Engraved markers: a natural stone marker engraved with the page's QR code, made to order and shipped to you, with a memorial page included.
- Upgrades: you can add an engraved marker to a memorial bought as The Page later. What you already paid counts toward it, and the page and its QR code stay the same.
Each package's photo limit, story length and number of family editors are shown when you choose it.
2. Your account
You need to be 18 or older to buy or create an account. Please give accurate details, keep your password to yourself, and tell us straight away if you think someone else has used your account. You're responsible for what's done through it. We recommend turning on two-factor login. We may suspend an account that's being used to break these terms.
3. Orders, prices and payment
- Prices are in Canadian dollars. Any taxes that apply are added at checkout.
- Payment is taken by our payment processor, Stripe, when you order. Your order is confirmed when we email you.
- If we can't fulfil an order (for example, if the stone you chose becomes unavailable), we'll contact you to offer an alternative or a full refund.
- If a price on the site is clearly wrong, we'll contact you before going ahead, and you can cancel for a full refund.
4. Engraved markers
- Each marker is engraved for you after you order. Making it takes up to 5 business days, and we ship within Canada only. Delivery details are in our Refund & Shipping Policy.
- Natural stone varies. Colour, texture and edges differ from stone to stone and from our photos, and engraving shows lighter than the stone around it. That's part of each marker being unique, not a defect.
- Scan your marker with a phone before placing it. Outdoors, moss, dirt, chips, snow and weathering can make any QR code harder to scan over time. Clean it gently with water and a soft brush, never a pressure washer or chemicals. The page's code is also engraved as text: if the QR code ever becomes hard to scan, send us that code and we'll help you reach the page.
- Cemeteries often have rules about what can be placed at a grave. Please check them before placing a marker. We're not responsible if a cemetery doesn't allow it.
5. Your memorial page and its content
What you add stays yours. You give us permission to store, display, back up and copy your content only as needed to provide MyStoryStays: showing the page, making its QR card and downloadable copy, and keeping it safe. This permission ends when the content is deleted, apart from backups, which are replaced within 35 days.
By adding content, you confirm that you have the right to share it, usually as close family, and that you have permission for photos of other people or taken by others.
Please don't add or allow content that:
- is unlawful, hateful, threatening or harassing, or mocks the person being remembered;
- infringes someone else's copyright or other rights;
- shares another living person's private information (such as their address or health details) without their permission;
- is advertising, spam, or has nothing to do with remembering the person.
Owners can approve and remove guest book messages. We don't review pages before they're published, but if we're told a page breaks these rules, or we receive a valid legal complaint, we may hide it or remove content after looking into it. Where we can, we'll tell the owner first. To report a page, email hello@mystorystays.ca with its link.
6. How long memorial pages stay online
Memorial pages stay online for as long as MyStoryStays operates. There are no renewal fees. You can download a complete copy of a page (story, photos, guest book and QR code) from your dashboard at any time, and it opens in any web browser, even offline. If we ever have to close, we'll email every account owner at least 90 days beforehand so they can download their pages.
You can unpublish or ask us to delete a memorial page at any time. Deleting a page means its QR code no longer opens it.
7. Refunds and cancellations
See our Refund & Shipping Policy. In short: The Page (no marker) can be refunded within 30 days, and marker orders can be cancelled for a full refund until engraving starts. Damaged, defective or wrong markers are replaced or refunded.
8. Keeping the site running
We work to keep MyStoryStays available and your content safe, with regular encrypted backups. Occasionally the site may be briefly unavailable for maintenance or for reasons outside our control.
9. Our responsibility to you
To the extent the law allows, we aren't liable for indirect or consequential losses. Our total responsibility for any claim about an order is limited to the amount you paid for that order. Nothing in these terms limits your rights under Ontario's Consumer Protection Act, 2002, or other consumer protection laws that apply to you.
10. The law that applies
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If you live in another province, you keep the consumer protections of your own province.
11. Changes to these terms
We may update these terms. We'll change the date at the top and, for significant changes, email account owners first. The terms that applied when you placed an order apply to that order.
